Acceptable Use Policy (AUP)

Introduction and Purpose
This Acceptable Use Policy ("AUP") supplements the Service Terms and Conditions and explains the permitted and prohibited uses of the Radiant Mobile service provided by Compax MVNO Venture, Inc., doing business as Radiant Mobile a marketing brand operated by Radiant Mobile LLC (“Radiant”, "Compax," "we," "us," or "our"). The AUP is intended to protect the security, reliability and performance of the network for all customers, to ensure compliance with applicable law, and to prevent misuse, fraud, or activities that jeopardize Compax’s relationships with its Mobile Network Operator (MNO) partners. By using the Radiant Mobile Service you agree to comply with this AUP.
Scope
This AUP applies to all users of the Radiant Mobile service and any devices, equipment, or SIM/eSIM profiles provisioned by Compax. It covers voice, SMS/MMS, data, messaging, signaling, and any ancillary services provided by Compax or its partners. Compax may amend this AUP from time to time; continued use of the Service after posting constitutes acceptance.
Permitted Use
The Radiant Mobile Service is intended for personal, non-commercial use unless you have a separate, written agreement with Compax expressly permitting commercial use. Permitted uses include standard voice calls between individuals, person-to-person messaging, typical web browsing, access to applications, and reasonable tethering as may be specified in your plan. Reasonable use shall be determined by Compax in light of ordinary consumer usage patterns.
Prohibited Uses and Examples of Abuse
• Reselling, rebranding, re-provisioning or otherwise making the Service available to third parties without Compax’s prior written authorization.
• Using the Service primarily for commercial, business, wholesale or carrier-like activities, including operating call centers, PBXs, conferencing, or machine-to-machine gateways.
• Automated, bulk, or mass messaging or calling (including autodialing, robocalls, SMS blasting), or any activity intended to distribute unsolicited communications.
• Continuous or excessive tethering, sustained machine-to-machine connections, hosting servers, running persistent peer-to-peer networks, or operating services that maintain continuous inbound connections.
• Using the Service to avoid payment or to generate excessive chargebacks, or using multiple accounts or SIMs to circumvent plan limitations.
• Excessive international roaming or usage outside the geographic scope of your plan in a manner inconsistent with reasonable personal use.
• Transmitting, distributing or storing material that is unlawful, defamatory, obscene, infringing, harmful, or that promotes illegal activity, including malware, viruses, or denial-of-service attacks.
• Attempting to gain unauthorized access to Compax, MNO or third‑party networks, systems or data, or engaging in activities that hinder network operations or security.
• Relaying calls, messages, or data that did not originate from the Compax‑provisioned device or SIM/eSIM (including transit or gatewaying of bulk traffic).
• Using software or hardware to alter firmware, bypass device restrictions, spoof IMSI/IMEI or engage in SIM cloning.
• Any use that causes significant congestion, degradation of service for other users, or otherwise threatens the integrity, reputation, or contractual obligations of Compax.
Network Management, Enforcement and Remedial Measures
Compax reserves the right to monitor, investigate and take any remedial measures it deems reasonable to enforce this AUP, protect customers, and preserve network performance. Without limiting the foregoing, Compax may: (i) warn users via email, SMS or account notice; (ii) impose temporary or permanent speed reductions, throttling, or deprioritization; (iii) block, filter, limit, or suspend specific services, ports, protocols, applications, or traffic types; (iv) temporarily suspend or terminate accounts or specific SIM/eSIM profiles; (v) limit the number of unique international destinations, calls, or messages per billing period; (vi) require verification of identity and usage intent; and (vii) pursue civil or criminal remedies.
All remedial measures will be implemented in good faith to protect the network, other users and Compax’s commercial relationships. Compax will apply measures consistently with the nature and severity of the misuse and will, where feasible, provide notice and an opportunity to remedy before permanent termination.
Monitoring, Data Processing and Legal Bases
Compax may monitor network traffic and process associated metadata and content to the extent necessary to detect fraud, enforce this AUP, comply with legal obligations (including lawful intercept and emergency services), and to protect network security. Such monitoring and processing is based on Compax’s legitimate interests in fraud prevention, network management, legal compliance and safety, and where applicable, contractual necessity to provide telecom services. Where required by law, we will seek your consent before processing content for certain marketing or third‑party integrations. Monitoring activities are conducted in accordance with our Privacy Policy and applicable legal standards.
Notice, Investigation and Remediation Process
When Compax detects suspected abusive, fraudulent or unlawful activity, Compax may initiate an investigation. Compax will endeavor to provide notice to the account holder at the primary email address or phone number on record when practicable and safe to do so. The notice will describe the suspected conduct and the remedial steps being taken. Compax may require the account holder to provide additional information or to complete verification steps. If the account holder does not respond to a legitimate notice within the timeframe specified, Compax may suspend or terminate service without further notice. Compax may, in its discretion, refer evidence of criminal activity to law enforcement or regulatory authorities.
Appeals, Dispute Resolution and Arbitration
If you believe Compax has improperly applied this AUP, you may submit an appeal through our customer care channels within 30 days of notice. Compax will review the appeal and may reverse, modify or confirm the remedial action. Nothing in this AUP limits Compax’s right to seek injunctive relief or pursue legal claims. All disputes are subject to the dispute resolution provisions in your Service Agreement, including any arbitration agreements and venue selections.
Liability, Disclaimer and Indemnification
TO THE FULLEST EXTENT PERMITTED BY LAW, COMPAX, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS AND SUPPLIERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO ENFORCEMENT OF THIS AUP, INCLUDING BUT NOT LIMITED TO LOSS OF REVENUE, LOSS OF BUSINESS, LOSS OF DATA, OR INTERRUPTION OF SERVICE. COMPAX’S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE ENFORCEMENT OF THIS AUP SHALL NOT EXCEED THE AMOUNT PAID BY YOU FOR SERVICES DURING THE SIX (6) MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY. YOU AGREE TO INDEMNIFY, DEFEND AND HOLD HARMLESS COMPAX FROM ANY THIRD-PARTY CLAIMS ARISING OUT OF YOUR USE OF THE SERVICE, YOUR VIOLATION OF THIS AUP, OR BREACH OF LAW.
CPNI, Lawful Intercept and Regulatory Cooperation
Compax will comply with FCC rules regarding Customer Proprietary Network Information (CPNI) and with lawful intercept requirements. Compax will respond to lawful requests from government agencies and regulatory bodies, and will maintain records, audit trails, and secure procedures for lawful disclosures. Compax will challenge or limit overly broad requests where permitted.
Miscellaneous Provisions
No waiver: Failure by Compax to exercise any right or remedy under this AUP does not constitute a waiver of such right. Severability: If any provision of this AUP is held invalid or unenforceable, the remaining provisions remain in effect. Assignment: Compax may assign its rights and obligations under this AUP in connection with a corporate transaction. Governing law: This AUP is governed by the laws of the State of Oregon and applicable federal law. Service of process: Any legal process shall be served in accordance with the Service Agreement.
